A big thanks to all who called, wrote, faxed, and/or attended
last Thursdays Planning Meeting. We had a small victory
. a continuance of the
tentative map that shows that we do indeed have a voice and a vote. The developer has
asked to meet with us. We selected Monday, May 3rd at 6:30 p.m. at Franklin Schools
Multipurpose Room. Please come for a one on one with the developers and speak your mind.

The county states that they are bound by the 1983 Development Agreement and although
technically they are. We all know that a planning commission and the Board of Supervisors
can use their power and influence to negotiate changes in a development agreement. There
are items that still need to be negotiated under the CEQA laws that allow the county to
require changes. As both attorneys noted the contract of 1983 can still be negotiated on
items.
The developer has requested not to put in the equestrian trails in Los Lagos #3 and
exchange for putting in trails along Auburn-Folsom Road in Los Lagos #5. There was
originally suppose to be 7.5 miles of public pedestrian trails provided. The developer has
also requested that each driveway along Boulder Road have private access gates. The Master
Plan and 1983 Developer Agreement doesn't allow this. There is a great deal of question of
whether Los Lagos #3 will even be part of the current Los Lagos.
Issues that weren't addressed to our satisfaction were the use of Twin Rocks, Walden Woods
Way, & Boulder Road. Although the County put in a condition that construction vehicles
for subdivision improvements or homes is not permitted on Twin Rocks and Walden Woods Way.
The developer's lawyer "informed" the Planning Commission that they considered
this a breach of the agreement. That construction traffic would be classified as the
initial construction phase and that the original agreement didn't ban the use of Walden
Woods Way.
Issues that were never addressed in 1983 were studies on the water pollutant run offs from
construction and residential use of pesticides and fertilizer on Granite Lake in Lakeview
Hills and the mitigated wetlands preservation. The detention ponds that are proposed for
holding water run off and pollutants are in fact in the wetlands preservation easements. A
study was conducted on the safety of children playing on the streets within the Los Lagos
#3 development but no study was done on children playing on the streets outside Los Lagos
#3 in the surrounding communities. No impact report has been done on removing the oak
trees along Boulder Road in order for the developer to do the agreed widening of the road.
The Planning Commissioner informed us to continue to put pressure on the entire Board of
Supervisors. So write, call, and fax the Planning Commission and the Board of Supervisors.
The next Planning Commission Meeting is May 13, 1999 at 3:30 p.m. Keep the pressure on.
